WARRANTY TERMS AND CONDITIONS

LIMITED WARRANTY

FOR ZODIAC POOL LINER, SIDEWALL STEEL, RESIN

AND OTHER STRUCTURAL COMPONENTS

TERMS AND CONDITIONS

The Zodiac Pool Liner, PVC Components, Sidewall Steel, other Structural Steel and Resin Components of this Zodiac Pool are warranted by

Zodiac Group Australia Pty Ltd ("Zodiac") from the date of purchase to the extent set out in the terms and conditions below ("Warranty"):

ZODIAC STEEL SIDEWALL AND OTHER STRUCTURAL STEEL & RESIN COMPONENTS

(ZODIAC AND VOGUE POOLS STEEL & RESIN STRUCTURAL COMPONENTS)

– 20 YEAR PRO-RATA LIMITED WARRANTY

1. Zodiac, at its sole option, will replace any Zodiac structural steel or resin components which Zodiac reasonably finds to be

defective during the first five (5) years from the date of purchase.

2. Zodiac will replace any Zodiac steel or resin structural components, which Zodiac reasonably finds to be defective in the sixth

(6th) year from date of purchase at the pro rated cost of 25% to the purchaser at the manufacturers suggested retail price for

the replacement components at the time of the accepted claim. From the beginning of the seventh (7th) year to the end of the

twentieth (20th), the cost of the replacement to the purchaser will increase by 5% on the annual anniversary of the purchase.

(i.e. during the tenth (10th) year the cost to the purchaser will be 45% -25% plus 5% for each of the preceding four years to

the tenth (10th).

3. Zodiac, at its sole option, will repair or replace free of charge the Zodiac Hung Printed Pool Liner or PVC Components which

Zodiac reasonably finds to be defective in the first year from the date of purchase.

4. Zodiac will replace the Zodiac Hung Printed Pool Liner or PVC Components which Zodiac reasonably finds to be defective

from the second (2nd) year to the end of the fifth (5th) year from the date of purchase at a pro-rated cost to the purchaser

equal to the following corresponding percentages of the manufacturer’s suggested current retail price for the replacement

Zodiac Hung Printed Pool Liner or PVC Components at the time of the accepted claim:

second year – 20%; fourth year – 60%;

third year – 40%; fifth year – 80%.
